The TCPA sets out very strict laws about what telemarketers, debt collectors, and other similar agencies can do. Even if you owe them money, debt collectors are forbidden to do any of the following:

  • They are never allowed to call you after 9:00 in the evening or before 8:00 in the morning.
  • They are not allowed to call you at your place of work if you requested that they not do so.
  • They are not allowed to call you so many times during a single day that is unreasonable, or to continue calling you after you’ve asked them to stop.
  • They are not allowed to call your cell phone and pretend that they’re calling somebody else.
  • They are not allowed to claim falsely that they are going to ruin your credit.
  • They are not allowed to tell anybody about your debt other than your spouse.
  • They are not allowed to threaten you with garnishment of your wages, a lawsuit, or any other legal activity.
  • They are not allowed to try to collect any amount other than what is actually owed.
  • They are not allowed to try to collect on a debt that isn’t yours, or to report a debt that isn’t yours on your credit report.
  • They are required to let you know on every phone call that their call is from a debt collector and that they can use any information that is given to them as part of their debt collection effort. If they fail to give you these warnings, they are in violation of the law.
