South Jersey Collections Defense Attorney

It’s bad enough to live under the shadow of debt, but when debt collectors are pursuing you, it can make you even more miserable. Unfortunately, far too many people who are being harassed are unaware that there are laws that specifically prohibit these types of actions. The Telephone Consumer Protection Act, or TCPA was written to keep banks, collection agencies and telemarketers from the abusive activities, and if they violate the law then you may be entitled to compensation. At Reinherz Law, we are a South Jersey collections defense attorney dedicated to providing our clients with more than just protection: we want to make sure that you get justice. If you’ve been on the receiving end of these types of calls and you think they might be violating the law, call us and we’ll advise you of your rights.

The TCPA sets out very strict laws about what telemarketers, debt collectors, and other similar agencies can do. Even if you owe them money, debt collectors are forbidden to do any of the following:

  • They are never allowed to call you after 9:00 in the evening or before 8:00 in the morning.
  • They are not allowed to call you at your place of work if you requested that they not do so.
  • They are not allowed to call you so many times during a single day that is unreasonable, or to continue calling you after you’ve asked them to stop.
  • They are not allowed to call your cell phone and pretend that they’re calling somebody else.
  • They are not allowed to claim falsely that they are going to ruin your credit.
  • They are not allowed to tell anybody about your debt other than your spouse.
  • They are not allowed to threaten you with garnishment of your wages, a lawsuit, or any other legal activity.
  • They are not allowed to try to collect any amount other than what is actually owed.
  • They are not allowed to try to collect on a debt that isn’t yours, or to report a debt that isn’t yours on your credit report.
  • They are required to let you know on every phone call that their call is from a debt collector and that they can use any information that is given to them as part of their debt collection effort. If they fail to give you these warnings, they are in violation of the law.

Even if you owe the creditor a great deal of money, you are still entitled to these protections, and the South Jersey collections defense attorneys at Reinherz Law are committed to making sure that you are protected against this type of harassment. Not only can we make it stop, but we can also help you to collect the money that the companies owe you in penalties for violating your rights. Call our office today to set up a free consultation. We will listen carefully and give you the answers you need about the help we can provide.
